Terms and Conditions for Finshark’s Services.
1. General
These terms and conditions (the “Testing Terms”) apply when and if you sign up as a tester of Finshark’s Account Information Services and Payment Initiation Services (the “Services”).
As testing will include actual use of the Services, the General Terms and Conditions for Finshark’s Account Information Services and Payment Initiation Services Users (“the User Terms and Conditions”), will also apply as presented in Finshark’s online solution and attached hereto. In case of any discrepancies between the Testing Terms and the User Terms and Conditions, the latter will prevail.
Finshark is a Swedish-based account information service provider and payment initiation service provider offering account information services (“Account information services” or ”AIS”) and payment initiation services (“Payment initiation services” or ”PIS”) (individually the “Service”, together the “Services”).
Account information services enable the user, to see its payment account information from different bank accounts in one place online or via a mobile app, while Payment initiation services enable the user to pay with funds that are withdrawn directly from its online bank accounts, as further set out and regulated in EU’s Revised Payment Services Directive (“PSD2”) (Directive (EU) 2015/2366) and any applicable national legislation.
Finshark holds all relevant licenses to provide the Services. The Swedish Financial Supervisory Authority (Finansinspektionen) is our home state supervisory body. Required licenses have subsequently been duly registered and issued in all relevant jurisdictions to enable Finshark to provide the Services.
2. Terms
To be a tester of the Services, you must be authorized to enter into contracts. By submitting your application, you agree to perform this Testing, guarantees that you have understood and accepts the Testing Terms, our Privacy Policy and our User Terms and Conditions.
Upon signing of these Testing Terms, a Finshark’s representative will contact you to schedule testing session(s) and will describe the planned testing in detail.
You are responsible to ensure that details and/or information about our products, functions etc that you obtain during the testing are handled as confidential matters, unless Finshark have made such information available to the public or given you its written consent to disclose such information.
You will be paid 30 EUR per hour (or 223,00 DKK/315,00 NOK depending on the market you are testing for) wherein you may be asked to do one or two testing. The duration of each teaching varies, but it normally takes around 20 minutes per testing.
To receive your payment, Finshark's representative will communicate with you to request your bank information on where your testing payment will be submitted to.
We will send your payment on your provided bank by the end of each week.
Testing will also require that you make smaller transfers between accounts. The amounts will always be low (e.g., 1SEK/NOK/EURO etc). The accumulative amount used during testing, will be refunded to you along with the general payment for testing.
If a testing session is interrupted, there is a need for a follow-up session, etc., Finshark will contact you and reschedule a new session.
You are free to terminate this Testing Terms and withdraw from testing at any point in time.
3. Privacy
To perform testing under the Testing Terms, Finshark will need your name and contact information.
Further, you will have to make authorization(s) in your online bank(s) giving Finshark access to your account(s). This will be a standard authorization regulated by PSD2 and further described in the User Terms and Conditions. Based on this, we will be given access to your account number(s) and see payment and other account-related data from your online bank, during the testing session in line with the descriptions in the User Terms and Conditions.
The purpose of this is to test the functionality and standard of connectors and other technical features of various European banks where you hold one or more bank accounts.
Finshark will only use your personal data for testing with you present, either physically or online. The personal data that is related to using our Services as part of the testing, will be processed as set out in our User Terms and Conditions and Privacy Policy.
Any personal data that is processed directly as a result of testing, for example, screenshots of errors incurred, or personal data that is included in the test results will be anonymized or otherwise deleted once the testing session is finished.
You may terminate these Testing Terms at any time, by contacting the Company’s representative. After the testing session, we in Finshark will manually remove our access to your online bank(s) by deleting the so-called “token” used to gain technical access.
We will process your personal data in accordance with the Testing Terms, the User Terms and Conditions, our Privacy Policy, and the GDPR. You will be able to make use of your rights as a data subject under the GDPR, including your right to access, rectification, erasure, restriction of use, and export.
